Flux Sewer Ltd – Terms & Conditions for Flux Fix Maintenance Packages

1. Definitions

“Company” refers to Flux Sewer Ltd.

“Client” refers to the landlord, business, or property management company purchasing a maintenance package.

“Services” means the inspections, cleaning, descaling, repairs, and emergency response as outlined in the selected package (Essential, Pro Care, Premium).

“Property” means the address or site covered under the maintenance agreement.
2. Service Scope
2.1. Services are provided as described in the selected package tier.
2.2. Annual inspections, cleaning, descaling, and minor repairs are included as per package details.
2.3. Major repairs, excavation, replacement of drainage systems, or works outside normal maintenance will be quoted separately.
2.4. Emergency response times (24hr, 12hr, 4hr) apply during normal business hours unless 24/7 coverage is specified in the Premium package.
3. Client Responsibilities
3.1. The Client must provide safe and reasonable access to the Property at agreed times.
3.2. The Client must notify the Company promptly of any drainage issues.
3.3. The Client is responsible for ensuring tenants/customers comply with proper drain usage (e.g. no inappropriate items flushed or disposed).
4. Pricing & Payment
4.1. Package fees are payable annually in advance, unless otherwise agreed in writing.
4.2. Discounts for multiple properties apply only when all properties are signed under one agreement.
4.3. Emergency call-outs not included in the package will be charged at the Company’s standard emergency rates.
4.4. VAT will be charged at the prevailing rate.
5. Term & Renewal
5.1. The agreement runs for 12 months from the date of contract signing or invoice issue.
5.2. Packages automatically renew annually unless cancelled in writing with 30 days’ notice prior to renewal.
5.3. Prices may be reviewed annually and adjusted with at least 30 days’ notice.
6. Liability & Limitations
6.1. The Company will carry out Services to a professional standard in line with industry practice.
6.2. The Company is not liable for:

Pre-existing drainage defects or damage;

Misuse or negligence by tenants/third parties;

Damage caused by unforeseen events (e.g. flooding, subsidence).
6.3. The Company’s liability is limited to the value of the annual package fee paid.
7. Cancellation & Termination
7.1. The Client may cancel within 14 days of agreement start for a full refund, provided no Services have been delivered.
7.2. After this period, no refunds will be issued.
7.3. The Company reserves the right to terminate the agreement if the Client fails to pay or breaches terms.
8. Governing Law
8.1. These Terms & Conditions are governed by the laws of England & Wales.
8.2. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
